TERMS AND CONDITIONS
The following terms and conditions do not affect your statutory rights and relate to orders placed by telephone, fax, post, Email or on line. Placing an order with us confirms your acceptance of these conditions. 1. GENERAL These conditions shall be incorporated in any order placed as above by any party (hereinafter referred to as the "Buyer") to Clarik Engineering Services having a place of business at 13 Forth Crescent, Dalgety Bay, Fife (hereinafter referred to as "Clarik"). No party other than a principal of Clarik is authorised to make any representation, warranty or otherwise or to transact any business on behalf of Clarik and these terms and conditions will be deemed to be incorporated in any order placed as above with Clarik and the Buyer shall be deemed to have full knowledge thereof. These terms and conditions will be deemed to prevail in the event of any dispute with Clarik and any contract entered into will be governed by Scots Law and the Buyer hereby submits to the exclusive jurisdiction of the Scottish Courts. 2. PLACING AN ORDER The Buyer, if an individual, must be over eighteen years of age and orders will be accepted by Clarik at their sole discretion by telephone, fax, Email and on line. Clarik may ask the Buyer to place the order in writing at the discretion of Clarik. Clarik do not accept orders for delivery outwith the United Kingdom. 3. PAYMENT Clarik in their sole discretion may accept payment by all major credit and debit cards. All payments on line will be by secured method under the Worldpay System. Payment will be required when placing an order and Clarik may withhold acceptance of such order or suspend performance of any contractual obligation until satisfied that payment has been received. Until payment has been made to Clarik in full no ownership in any goods shall pass to the Buyer and any goods received by the Buyer before payment in full shall remain in the ownership of Clarik or the supplier of any such goods to Clarik. 4. DELIVERY Clarik aim to arrange for delivery on all available catalogue items to mainland United Kingdom within one working day if ordered as above and accepted by Clarik before 2.00 p.m. the previous working day. Clarik will endeavour to achieve this Clarik will not be liable for any losses suffered by the Buyer if such orders placed as above are not delivered to or received by the Buyer within one working day. Clarik will aim to achieve delivery of all orders placed as above for all palettes within two to three working days from the date of acceptance by Clarik of such order but Clarik shall not be liable for any losses suffered by the Buyer if such delivery date is not achieved. 5. DELIVERY CHARGES
(a) All delivery charges will be payable at the time of the placing of the order and acceptance of the same by Clarik. Clarik will advise of such charges at the time of the placing and acceptance of such order. (b) Order Values and Delivery Charges are exclusive of VAT. 6. V.A.T. Value Added Tax (or any similar substituted tax) at the appropriate rate will be added to the price quoted in the catalogue and to the total cost of the order at the time of the placing and acceptance of such order. 7. CATALOGUE AND PRICES All items detailed in the catalogue and all prices are subject to variation without notice. 8. GUARANTEE All goods supplied to the Buyer by Clarik will be supplied with the original manufacturer's guarantee only. 9. RETURNS PROCEDURE All goods bought through Worldpay are subject to a 7 day 100% satisfaction guarantee, whereby if the buyer is not 100% satisfied with the goods supplied, they may be returned (at the buyers own expense) for a full refund or credit .This guarantee does not cover goods that have been used, damaged or defaced in anyway, or are not returned in re-saleable condition and in the original packaging with a valid invoice number. Goods and items supplied to the buyer from Clarik can only be accepted for return to Clarik with Clarik's written agreement and prior authorisation which written agreement and authorisation must be obtained within 7 days from the date of delivery to the buyer of the relevant item and if so accepted by Clarik for return then the goods must be returned undamaged in re-saleable condition and in their original packaging with a valid invoice number. 10. COMPLAINTS PROCEDURE All complaints, notices and correspondence should be in writing addressed to Clarik Engineering Supplies at the address above and should be sent by First Class Post and/or Recorded Delivery and shall be deemed to have been received by Clarik from destinations in mainland United Kingdom within three working days after the date of despatch and within five working days if despatched from non mainland United Kingdom. Any correspondence, notice or otherwise by Clarik to the Buyer in terms of these Terms and Conditions shall be deemed to have been received by the Buyer three days after its despatch by Clarik to the address supplied by the Buyer to Clarik at the time of placing the order. 11. RISK, DAMAGE AND LOSS Risk in any goods supplied to the Buyer will pass upon delivery of the goods to the Buyer at the address provided by the Buyer at the time of placing the order. The Buyer must inform Clarik within three working days from the date of despatch of the goods if a claim, whether for loss in transit or non-delivery, is to be made. Such intimation to Clarik must be followed up in writing within seven days of the date of despatch of the goods by Clarik. No claim will be considered by Clarik nor any liability accepted unless notification is received by Clarik as aforesaid and in respect of which time shall be of the essence to the Buyer. 12. LIABILITY FOR DEFECTIVE GOODS Clarik will not be liable for any loss of profits, inconvenience, disappointment, indirect or consequential loss or damage or damage arising out of any problem in relation to the goods supplied and shall have no liability to pay any money to any Buyer by way of compensation other than any refund provided that the goods are returned in accordance with the return procedures above specified. 13. PRIVACY POLICY We are committed to protecting your privacy. We will only use the information that we collect about you lawfully. Your personal information will not be disclosed to any third parties. We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. We will give you the chance to refuse any marketing email from us in the future. The type of information we will collect about you includes: your name We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.
